1. Our Services

Enhanced Prime provides technology and business automation services that may include:

• automated lead follow-up;
• missed-call text-back systems;
• SMS and email automation;
• AI-powered receptionist or conversational systems;
• appointment scheduling;
• customer relationship management (CRM) tools;
• lead pipeline management;
• website development and hosting;
• lead capture forms;
• reputation and review-management tools;
• AI-assisted content generation;
• Fast-Postr or similar content-generation products;
• system integrations;
• consulting, setup, maintenance, and optimization services; and
• other related software or services.

Specific Services provided to a customer may be described in an order form, proposal, invoice, checkout page, service agreement, or other written agreement. If another written agreement between you and Enhanced Prime conflicts with these Terms, the more specific written agreement controls to the extent of the conflict.

2. Eligibility and Business Use

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. Unless otherwise stated, Enhanced Prime's Services are intended primarily for business and commercial use. You are responsible for ensuring that your use of the Services complies with all laws, regulations, licensing requirements, and industry rules applicable to your business.

3. Accounts and Business Information

You agree to provide accurate, complete, and current information about your business, including business name, services offered, pricing, operating hours, service areas, scheduling availability, cancellation policies, FAQs, contact information, and customer service procedures necessary to configure your systems. You are responsible for promptly notifying us when this information changes. Enhanced Prime is not responsible for errors caused by inaccurate, outdated, incomplete, or misleading information provided by you.

4. Setup and Implementation

Some Services require setup, customization, configuration, onboarding, integrations, data imports, phone-number provisioning, domain configuration, website development, or workflow creation. Implementation timelines are estimates unless expressly guaranteed in writing. Delays caused by missing information, delayed approvals, third-party providers, client-side technical problems, regulatory reviews, or carrier registration may extend implementation timelines.

5. Fees and Payment

You agree to pay all fees disclosed to you before purchase, which may include setup fees, monthly subscription fees, usage fees, website fees, phone/SMS charges, AI usage charges, integration fees, and add-on services. Quoted fees are in U.S. dollars unless stated otherwise. You authorize Enhanced Prime and its payment processor to charge your provided payment method.

6. Recurring Billing and Automatic Renewal

Recurring subscriptions automatically renew until canceled. Before becoming obligated, applicable charges, frequency, and cancellation terms will be disclosed. Cancellation prevents future renewal charges but does not automatically entitle you to a refund of fees already earned or charged.

7. Cancellation & 8. Refund Policy

Customers may cancel recurring monthly Services before the next billing date. Setup, implementation, custom development, domain, phone-number, usage, and completed-work fees are generally non-refundable unless required by law or stated otherwise in writing.

9. Customer Responsibilities & 10. Leads & Consent

You are responsible for operating your business lawfully, maintaining required licenses, securing consent for phone/SMS/email communications, and honoring opt-outs and do-not-call rules under TCPA, TSR, CAN-SPAM, and state laws.

11. SMS & Telemarketing Compliance & 12–13. AI Systems

Your use of calling, texting, email, AI receptionists, and generative AI must comply with applicable laws. AI outputs are not specialized professional/legal advice; you are responsible for reviewing important pricing, policy, and scheduling commitments.

14–20. Third Parties, IP, Data & Liability

Enhanced Prime relies on third-party infrastructure and retains ownership of its software, templates, workflows, and proprietary tools. You retain rights in your customer data. To the maximum extent permitted by law, Services are provided "as is," and total liability is limited as described herein.
